SECTION ONE.
This sales agreement is made on ___/___/____ between:

Seller: Bacchus Cane Corso and Buyer: ___________________

SALE OF PUPPY
Seller shall sell, transfer, and deliver to buyer on or before _________, the said dog/bitch: ________
SECTION TWO.
CONSIDERATION
Buyer shall accept the PUPPY and pay $_________ for the PUPPY
SECTION THREE.
IDENTIFICATION OF PUPPY
Identification of the puppy to this agreement shall not be deemed to have been made until both buyer and seller have specified that the puppy in question is to be appropriated to the performance of this agreement.
SECTION FOUR.
PAYMENT ON RECEIPT
Buyer shall make payment for the puppy at the time when, and at the place where, the puppy is received by buyer.
SECTION FIVE.
RISK OF LOSS
The risk of loss from any casualty to the puppy, regardless of the cause, shall be on seller until the goods have been accepted by buyer.
SECTION SIX.

WARRANTY OF NO ENCUMBRANCES
Seller warrants that the puppy is now free, and that at the time of delivery shall be free from any communicable disease and birth defects and parasites at the time of purchase per health certificated provided with the puppy.
SECTION SEVEN

RIGHT OF INSPECTION
Buyer shall have the right to inspect the puppy on arrival and, within __3_______ business days after delivery, buyer must have puppy examined by a licensed veterinarian. Give notice to seller of any claim for damages on account of condition, of the puppy, in writing by a Licensed Veterinarian and buyer must specify the basis of the claim of buyer in detail. The failure of buyer to comply with these conditions shall constitute irrevocable acceptance of the puppy by buyer.
SECTION EIGHT
SHOW QUALITY: all show quality puppies are guaranteed to be free of Crippling Hip Dysplasia up to the age of 2 years. OFA pre- lims will not be accepted as the final diagnosis of Hip dysplasia the radiograph must be performed again at the age of two years at which time results will be accepted as final. If at any time before the age of 2years it is deemed by certified veterinarian that the puppy needs any type of orthopedic surgery, buyer must notify seller before giving permission to the veterinarian to proceed with surgery. Buyer must send copies of x-rays, doctors’ report etc. to sellers’ veterinarian.
Buyer must also obtain a second opinion from a veterinarian not associated with original veterinarian that gave the recommendation to do surgery. Seller’s veterinarian may be source of second opinion. I buyer proceeds with surgery without first contacting seller all terms of replacement puppy will be null and void.

If puppy is recommended by a licensed veterinarian to be sterilized the Seller must be made aware of the situation in writing. If the puppy is sterilized without notifying the seller all warrantees are null and void.
Any puppy sold as show quality must be shown unless the seller agrees to and signs a waiver. Puppy must attend if first show by the age of six months and must be shown a minimum of six times by the age of 2years old. If a 1st shows default occurs the Buyer agrees to pay the seller all of the fees associated with showing the puppy and the Seller will show the puppy.  Puppy must be shown at  the following  kennel clubs AKC, ARBA, IABCA, Rarites, CKC. One Weekend  equals one show.
Any puppy sold as show quality must not be bred before the age of two years old. And must pass a Hip certification either by OFA and or PEN Hip
Upon the diagnosis of any birth defect or genetic defect on a show quality puppy buyer agrees to have his vet provide seller with written proof of the problem within 5 business days of diagnosis. Diagnosis must be confirmed by sellers vet. Buyers have two options.
1. Buyer may elect to keep puppy, have him spayed or neutered proof of sterilization must be provided the buyer may receive $1000.00 off purchase price of a new show quality puppy.
2. Buyer may elect to return puppy with paperwork to seller agrees for a replacement puppy.
Registered name of dog will begin or end with the name of “Bacchus”/or “of Bacchus”
No replacements will be given due to problems which result from the buyers neglect.

 

SECTION NINE
CO- OWNERSHIP
This Show Quality puppy described as _____________________ being sold for the price of $______________, under the following conditions.
The puppy will be co- owned by the seller and the buyer until all obligations have been fulfilled.

Puppy will be bred at 2 years old to the male of the sellers choosing.
Puppy will not be bred to a male before the age of 2 years old, at which time if deemed to be suitable for breeding will be bred to a male that sellers choice.
Co- Owner will be entitled to 2nd pick puppy.
If only one puppy is born the Owner has the option of satisfying the obligation on one puppy to the Co- Owner or selling the puppy and splitting the proceeds of the puppy with the Co- Owner or doing a another breeding later and Co- Owner taken 2nd pick from that litter.
The Buyer will be responsible for all expenses and care of the above mentioned
Bitch as well as the litter produces when she is bred.
The puppy that the CO- Owner picks will carry Bacchus Cane Corso Name
If for some reason the bitch is found unsuitable for breeding, she will be replaced, per the terms of the general contract, and the theses terms will apply to the replacement bitch.
Under NO circumstances do we grant cash refunds or accept liability for medical expenses, veterinarian fees, or any other expense related to the care of your Cane Corso.
Buyer agrees to provide yearly vet exams. Buyer must continue inoculations and heartworm protection with a licensed veterinary and provide the Seller with documented proof of such. Puppy should be on a food formulated for large breeds. Not a home made food. Any violation of this will result in repossession of said puppy.
No guarantees are made regarding temperament. The temperament of your puppy is based on the amount of time you give your dog and socialization. Buyer agrees to enroll your puppy in Puppy Kindergarten and Basic Obedience.
Deposit is non- refundable
Buyer must give the seller first right of refusal if at any time they can no longer keep possession of above mentioned dog./bitch. No animal may be transferred, sold or otherwise to alternate owner. All fees incurred by seller for recovery will be the responsibility of the buyer.
Seller’s maximum responsibility is limited to the purchase price of the dog/bitch. Any subsequent expenditure is the sole responsibility of the Buyer.
By signing this contract all parties are acknowledging they have read and fully understand and agree to ALL Terms of this contract they also agree that all terms will be carried out as stated.
The parties have executed this agreement in Orange County Florida the day and year first above written
